VHAMPS TERMS OF SERVICELast updated November 15th, 2024Buying from me automatically means you've accepted these terms.These terms constitute a legally binding agreement made between you, whether personally or on behalf of someone else, and me concerning your access to and use of the services I'm providing. You agree that by purchasing ANYTHING from me that, you have read, understood, and agreed to be held accountable by all of these terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM PURCHASE AND YOU MUST DISCONTINUE/CANCEL ANY ACTIVE PURCHASES IMMEDIATELY.I reserve the right, in my sole discretion, to make changes or modifications to these terms at any time and for any reason. I will alert you about any changes by updating the "Last updated" date of these terms, and you waive any right to receive specific notice of such changes. It is your responsibility to periodically review these terms to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised terms by your continued use of the Services after the date such revised terms are posted.I reserve all rights to not do a commission or cancel a pending commisson for ANY reason (granted I give you a reason and an explanation). Naturally I will refund your money (if possible) if I were to cancel the work.The art you purchase is not intended for distribution or to be used by any person or entity without credit to the artist (vhamps). If you repost, share, or use the art you purchased in any way, all I ask is that you (1). do not alter, edit, or draw over my art, (2). remove the watermark added, and (3). use my art like it is your own. This includes, tracing, or posing with my art as your own. You're welcome to use the art however you like since it is yours but don't disrespect my work, my hard effort, and me personally by disregarding these terms.I am the owner of all the things in my caard, including all website designs, audio, video, text, photographs, and graphics within the caard. DO NOT use my caard as your own, or take any sort of resources, or design from my caard directly.Subject to your compliance with these terms, I grant you the right to purchase, use, and share the art bought to your liking solely for your personal, non-commercial use or internal business purpose. This includes reselling my work, tracing, reposting, and reposting without credit. Any personal profits made from my work after purchase is subject to royalty fees in the sum of 30% commission to the artist (vhamps).no part of my work, art or any other options may be copied, reproduced, aggregated, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without my explicit prior permission and compensation.If you wish to make any use of my services, art, or other works in any way outside of how I already permitted you to use it please address your request to: [email protected] and explain what you want to use it for, an why you'd like to use it that way. If I ever grant you the permission to post, reproduce, or publicly display any part of my art or other services, you must identify me (vhamps) as the rightful creator of the work and ensure that any watermarks appears or are visible when posting, reproducing, or displaying my work.Any breach of these terms will constitute a material breach of my trust and your right to use my service will terminate immediately.By purchasing from me you represent and warrant that: (1) you have the capacity to and you agree to comply with these terms and conditions; (2) you will not use my work or my name (vhamps) for any illegal or unauthorized purpose not stated here or approved by me; and (3) your use of my work will not violate any terms of service for any other platforms you decide to put it on. I will not be held responsible for any consequences you face for posting my work to another site where it is not welcomed.All products from me are subject to availability. I reserve the right to discontinue any products at any time for any reason. Prices for all products are subject to change. (This will not effect prior purchases).I accept the following forms of payment: US dollars via CashApp, or robux. Additional forms may be added later. Prices may be subject to change. I reserve the right to correct any errors or mistakes in pricing, even if I have already requested or received payment.I reserve the right to refuse any order placed. I may, in my sole discretion, limit or cancel quantities purchased per person, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same account from payment. I reserve the right to limit or prohibit orders that, in my sole judgment, appear to be placed by dealers, resellers, distributors, or people I feel have ill intent or have a history of defiling or tracing art.I try to maintain a kind and respectful tone however if I feel threatened, disrespected or pressured when talking to you i will return that energy ten fold. I reserve the right to block, or distance myself from people who decide to be rude, or disrespectful when speaking to me.If you feel the need to make a comment or complaint about anything regarding commissioning me then please send those to [email protected] as well.These terms shall remain in full force and effect at all times. If I feel you have breached these terms any and all purchases will be refunded and your right to use my work will be terminated. If I find that after I have revoked your right to use my work you are still using it as if nothing happened i will have to take legal measures against you. I do not wish for things to get that far so I will kindly ask you to stop whatever you're using my work for before taking any serious measures.If I choose to not accept commissions from you or block you, for any reason, you are prohibited from trying to purchase anything again from a new account, a fake or borrowed name, or the name of any third party, this also includes asking a friend to buy from me and using the work they purchased. In addition to banning you from purchasing from me, I reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.I reserve the right to change, modify, or remove the contents of my commissions at any time or for any reason at my sole discretion without notice. However, I have no obligation to update any information on my services or these terms. I also reserve the right to modify or discontinue the service in its entirety or part of the services without notice at any time. I will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the service.I cannot guarantee my commissions will be available or open at all times. I may experience hardware, software, personal, other problems or a need to perform maintanence related to my commisons, these terms, or my caard; in turn this may cause a pause in my commissions, or a suspension of my commissions in it's entirety, often resulting in interruptions, delays, or errors. I may also close my commissions because I'm full or simply not ready to do commissions. There is a such thing as a wait list and I will put you on it if my services are temporarily paused. I will notify you if this was to happen.Visiting any of my socials (including the caard), sending me emails, and completing online forms falls under electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications I provide to you electronically, via email and any and all of my socials is accepted and welcomed by you.In order to keep a full digital record I will have to keep record, of the name used when contacting me, basic contact information, payment method, and what you purchased.In order to resolve a complaint regarding my commissions you can contact any of the socials provided within my caard or the number listed down below.
